The terms of service for the Fuji peptide telehealth platform

This is the legal agreement between you and Fuji. It describes what the platform does, what the platform is not, the eligibility rules for treatment, the rules around compounded peptide medications, the billing and cancellation mechanics for subscriptions, and the dispute-resolution path that applies if something goes wrong. Read it before you create an account or place an order.

Acceptance and eligibility

These terms of service form a binding contract. By creating a Fuji account, completing the intake quiz, requesting a clinical consultation, placing an order, or otherwise using the platform in any way, you agree to be bound by what follows. If you do not agree, do not use the service. Continued use after a revision constitutes acceptance of the revised text; the section on modifications spells out how revisions are handled.

To use the platform you must be at least 18 years old. You must be a resident of the United States, physically located in a US state where the service is offered at the time you request care, and legally able to enter a binding contract. Use by anyone under 18 is prohibited. Use by anyone outside a state where Fuji operates is prohibited even if a US billing address is associated with the account.

If you are accessing the platform on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" in these terms then refers to both you and the organisation jointly and severally. Most users access the platform individually, which is the assumption that runs through the rest of this document.

Section read carefully. Section 18 below contains a binding arbitration agreement and a class-action waiver that affect how disputes are resolved. The arbitration agreement includes a 30-day opt-out window, also explained in Section 18. Read that section before you complete account signup.

What Fuji is, and what it is not

Fuji is a technology platform. It hosts the intake forms, the secure messaging tools, the order workflow, and the patient-facing dashboard that together let an adult in the United States request a telehealth consultation about peptide therapy and, where clinically appropriate, fill a resulting prescription through a partner 503A compounding pharmacy.

Fuji is not a medical practice. It does not employ the clinicians who review intake forms, conduct consultations, or write prescriptions. Those clinicians work in independently owned practices, hold their own state licences, carry their own professional liability insurance, and act as independent contractors in the network. Their clinical judgment is their own. Fuji does not direct, supervise, or override clinical decisions.

Fuji is not a pharmacy. It does not compound, hold inventory of, or dispense medication. A separate 503A compounding pharmacy receives prescriptions, compounds the medication for the individual patient, performs its own quality checks, and ships the finished product. The pharmacy is licensed by its home state board of pharmacy and operates under federal compounding rules.

Fuji does not provide insurance, does not bill insurance carriers, and does not act as a covered entity under HIPAA for activities outside the clinical relationship. The independent clinicians and the partner pharmacy are themselves covered entities, and the protected health information they create is governed by the HIPAA Privacy Notice.

What Fuji provides is the connective tissue: software, customer-support staff, fulfilment coordination, payment processing, and the brand experience. That is the platform you are agreeing to use.

No medical advice

Nothing on the marketing site, in the educational library, in product copy, in cohort-personalised landing pages, in support replies, or in any Fuji channel is medical advice. Marketing content is informational. It is written for a general audience. It may discuss peptide categories at a high level, summarise published research, or describe what a treatment programme often looks like, but it cannot diagnose your condition, evaluate your suitability for a given protocol, or recommend a dose. Only a licensed clinician acting in a clinical relationship with you can do those things.

Reading the website does not create a clinician-patient relationship. Completing the intake quiz does not, by itself, create one either. A clinical relationship begins only when a clinician licensed in your state has reviewed your intake, accepted you as a patient, and either issued a prescription or, more often, opened a written or video consultation. Until that point, what you read here is information and not care.

If you have an urgent medical concern, call 911 or go to the nearest emergency department. Fuji is not an emergency service and is not staffed for urgent or after-hours clinical issues.

Account registration

Most features require an account. To register, you give us a working email address, a password, and the legal name that will appear on prescriptions and shipping documents. You agree that the information you provide on registration and through your subsequent use is accurate, current, and complete, and you agree to keep it that way. Inaccurate registration data is a basis for account suspension.

You are responsible for safeguarding the password and for any activity that occurs under your account. Pick a strong password. Do not share it. Notify [email protected] as soon as you suspect unauthorised access. We are not liable for losses resulting from your failure to maintain the security of credentials in your control.

One account per person. Creating multiple accounts, sharing an account between people, or registering under a name that is not your legal name violates these terms. We may suspend or terminate any account we reasonably believe has been used in violation of this rule, with or without notice.

You may close your account at any time through the account settings or by writing to [email protected]. Closure is not retroactive. Charges accrued before closure remain payable, and shipments already in motion will complete unless they can be physically intercepted by the pharmacy partner.

User responsibilities and conduct

The platform is for personal, lawful use. You agree not to:

  • Provide false information at intake, on the quiz, in clinical messaging, or on payment or shipping forms.
  • Obtain or attempt to obtain medication on behalf of another person.
  • Resell, redistribute, or transfer any medication received through the platform.
  • Use the service to import or export medication across an international border in violation of US law or the law of the destination country.
  • Interfere with the operation of the platform, including by probing for vulnerabilities outside an invited security programme, by sending automated traffic, or by scraping content at volume.
  • Impersonate any clinician, pharmacy, staff member, or other user.
  • Use the platform in any way that violates applicable federal, state, or local law, or that infringes a third party's rights.

Honesty at intake is the single most important obligation in this section. Clinicians rely on what you tell them. A prescription based on inaccurate medical history may be inappropriate or unsafe. Misrepresenting medical history voids any expectation that the clinician's care can be reliably tailored to you, and it may void portions of the limited remedies discussed later in this agreement.

Clinical services and telehealth disclaimers

Clinical services are delivered exclusively by independently licensed clinicians who participate in the Fuji network. A clinician's review of your intake, any messages exchanged with you, any video consultation, any prescription written, and any clinical chart maintained for you is the work of that clinician and the practice in which they operate. Fuji is not a party to the clinician-patient relationship except in its capacity as the technology and administrative platform that supports it.

Eligibility for any treatment is determined by the clinician based on your medical history, the assessment performed during consultation, applicable clinical guidelines, the law of your state, and the clinician's own judgment. A clinician may decline to prescribe. A clinician may recommend a different protocol than the one you requested. A clinician may require additional information, lab work, or an in-person evaluation before continuing care. A clinician may discontinue care if continued treatment is no longer appropriate. None of these outcomes entitles you to a refund of fees paid for the clinical consultation itself, although a refund may apply to medication that was never compounded or shipped, as described in the cancellation and refund section.

Telehealth has limits. A clinician working through a remote channel cannot examine you in person, cannot run on-site diagnostic tests, and depends on the accuracy of the information you provide. You acknowledge that these limits exist and that the clinician will work within them. If at any point during care the clinician judges that the limits of telehealth make it unsafe to continue remotely, the clinician will refer you to in-person care and pause the platform-based programme.

Results vary. Peptide protocols are an emerging area of clinical practice. The published evidence base is uneven across the categories the network treats. Two patients on identical protocols may experience different outcomes. Fuji, the clinician network, and the partner pharmacy make no promise that a protocol will produce a particular result for you, and any statements about typical experience refer to averages, not guarantees.

Compounded medications, including 503A status

Most peptide protocols available through the platform are compounded medications. A compounded medication is a drug product mixed by a licensed pharmacist, for an identified patient, in response to a valid prescription. The legal framework that governs compounded medications in the United States is Section 503A of the Federal Food, Drug, and Cosmetic Act and the relevant state pharmacy laws.

This matters for two reasons that you need to understand before you accept treatment.

First, compounded medications are not FDA-approved. The Food and Drug Administration approves manufactured drug products that meet specific evidence standards for safety, efficacy, quality, and labelling. Compounded medications, by their nature, are prepared for individual patients and are not eligible for that approval pathway. The FDA does not evaluate the safety, efficacy, or quality of any compounded medication you may receive through the platform. The 503A pharmacy is responsible for its own quality programme under state law and federal compounding rules, and the platform discloses the pharmacy's identity on the order paperwork that accompanies each shipment.

Second, compounded medications are not identical to manufactured drug products. Even when a compounded medication contains an active ingredient that is also present in an FDA-approved product, the compounded version may differ in formulation, strength, excipients, presentation, and stability. A clinician's prior experience with a branded product does not automatically transfer to a compounded counterpart. The clinician will discuss those differences with you as part of the consultation. If you have a question about how a particular compounded medication differs from a branded equivalent, ask the clinician before you accept treatment.

You acknowledge that you have read this section, that you understand the regulatory status of compounded medications, and that you accept treatment with that understanding.

Branded medications

Fuji does not sell or dispense branded, FDA-approved drug products. Where a branded product is mentioned in marketing copy or in a clinician's note, the mention is informational and is intended to give you a familiar reference point. If a clinician determines that a branded product is appropriate for you, the clinician may issue a prescription for it that you fill at a pharmacy of your choice. The cost of that prescription is your responsibility. The platform does not coordinate or guarantee fulfilment of branded medications, and any subscription you maintain through Fuji does not include them.

Payment, subscriptions, and billing

Prices are shown in US dollars and exclude taxes unless stated otherwise. We may revise prices at any time; price changes apply to new subscriptions and to renewals after a reasonable notice period. The price that applies to an order is the price displayed on the order confirmation page at the time you place the order.

The platform supports one-time orders and recurring subscriptions. A subscription bills automatically on a cadence shown at signup (typically monthly or every 90 days, depending on the protocol). By starting a subscription you authorise the platform's payment processor to charge the card you provided on each renewal date until you cancel.

If a payment fails, the processor will retry the charge on a published schedule. We may pause your subscription and any pending shipment while the payment issue is resolved. Repeated payment failures may result in suspension of the account, in which case access to the clinical channel may be paused while the account is brought current.

The platform uses Stripe as its primary payment processor. We may also fail over to a secondary processor where commercial conditions require. Card details are tokenised by the processor and never reach the platform's servers in raw form. Disputes about a particular charge should be raised with us first; chargebacks issued without giving us a chance to resolve the matter will be defended on the merits, and may result in account suspension pending resolution.

Sales tax, where applicable, is calculated at checkout based on the shipping address. You are responsible for any other taxes, duties, or assessments that apply to the purchase.

Cancellation, refunds, and returns

You can cancel a subscription at any time from the account dashboard or by writing to [email protected]. Cancellation takes effect immediately for future renewals. It does not retroactively cancel a renewal that has already processed.

Once a subscription renewal has charged, the order moves into compounding. Because each compounded medication is prepared for a specific patient against a specific prescription, the standard refund window closes when the pharmacy releases the order for compounding. We will tell you, in the order confirmation email, the cut-off time after which a cancellation will not stop the shipment.

The refund position is structured around a few clear cases:

  • Cancellation before compounding starts. A full refund of the medication portion of the charge applies. Any consultation fee already earned by the clinician is not refundable.
  • Cancellation after compounding has started but before shipment. A partial refund may apply at our discretion, after we have confirmed with the pharmacy what costs have already been incurred. Where a partial refund is given, the credited amount will be itemised in the refund notice.
  • Cancellation after shipment. Compounded medications cannot be returned for safety reasons. Once a shipment leaves the pharmacy, the order is final. No refund is available on the medication portion of the charge.
  • Damaged, defective, or temperature-compromised shipments. If the medication arrives damaged or shows evidence that the cold chain failed, contact [email protected] within 48 hours of delivery with photographs. The pharmacy will assess and, where warranted, arrange a replacement at no additional cost. The Shipping Policy contains the detailed handling procedure.
  • Clinician declines to prescribe. If the clinician does not approve a prescription after intake, any pre-paid medication charge is refunded in full. The consultation fee covers the clinician's review time and is not refunded.

Refunds are issued to the original payment method. Processing time after we approve a refund depends on your card issuer, typically 5 to 10 business days. We do not issue cash refunds, and we do not credit a third party's payment instrument.

Service availability

The platform is available only to users in US states where Fuji has confirmed it can lawfully connect users with licensed clinicians and arrange dispensing from the partner pharmacy. The list of supported states is published on the eligibility step of intake and is updated as state regulations change. Use of the service from an unsupported state is a violation of these terms and a basis for refusing to fulfil any prescription that results.

Even within a supported state, particular protocols may be unavailable because of pharmacy supply, regulatory developments, or clinical-policy decisions made by the network. We do our best to flag those situations on the relevant product page, but we cannot guarantee that every protocol is available to every user at every moment.

We may from time to time take the platform offline for maintenance. Where we can give advance notice, we will. Where we cannot, the unscheduled downtime should not generally affect a scheduled shipment, because the pharmacy has the prescription record independent of the website.

Intellectual property

The Fuji name, the wordmark, the visual identity, the photography, the illustrations, the design system, the underlying software, and the original text on the website are owned by Fuji RX LLC or its licensors and are protected by US copyright, trademark, and other intellectual-property laws. The site as a whole is a copyrighted work.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the site for the purpose of evaluating, purchasing, and managing the services we offer. That licence does not extend to scraping the site at volume, reproducing material substantial portions of the site on a different platform, mirroring the site, training a machine-learning model on the site's content without our written permission, or building a competing product around our materials.

Third-party trademarks that appear on the site (drug brand names, the names of public studies, the names of regulatory bodies, the marks of our service providers) belong to their respective owners and are referenced for identification only. No endorsement is implied.

If you believe content on the platform infringes your copyright, send a notice that meets the requirements of the Digital Millennium Copyright Act to [email protected]. Include the work that has allegedly been infringed, the location of the infringing material on our site, your contact details, a statement of good-faith belief that the use is unauthorised, and a statement under penalty of perjury that your notice is accurate. We will respond as the statute requires.

User-generated content

From time to time the platform may invite you to submit content: a product review, an open-ended quiz answer, a question for the editorial team, a photo of an unboxing, or a piece of feedback you would like us to share with the clinician network. When you submit any of that, you grant Fuji a worldwide, royalty-free, sublicensable, perpetual licence to use, reproduce, modify, display, and distribute the content in connection with the operation, promotion, and improvement of the platform.

You retain ownership of the content. The licence above does not transfer ownership; it gives us the rights we need to use the content as a service operator would reasonably need to. We will not publish a review or any other piece of submitted content that includes a third party's personally identifying information without first removing or redacting that information, and we will not link your real name to a published review without your consent.

You represent that any content you submit is yours to submit (or that you have permission from whoever owns it), that it is accurate to the best of your knowledge, and that it does not violate the law or infringe a third party's rights. We may remove submitted content at any time at our discretion, and we may decline to publish content that is off-topic, abusive, defamatory, or otherwise problematic.

One specific note about intake answers. The information you provide during clinical intake is not user-generated content in the sense above. Intake data flows into the clinical record, is governed by the HIPAA Privacy Notice, and is not licensed to us for marketing purposes.

Privacy

How the platform collects, uses, shares, and retains personal information is described in the Privacy Policy. Protected health information is governed by the HIPAA Privacy Notice. Text-message communications are covered by the SMS Privacy and Consent notice. By using the platform, you acknowledge that you have had the opportunity to read those documents.

Disclaimer of warranties

To the maximum extent permitted by law, the platform and the services described in these terms are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. Fuji disclaims all implied warranties, including the warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the platform will be uninterrupted, that errors will be corrected on any particular timetable, that information presented on the site is free from inaccuracy, or that the platform will meet your specific requirements.

We make no warranty about the outcome of any clinical service. We make no warranty about the result of any compounded or branded medication. We make no warranty that the clinician network will offer treatment to you on the terms you expect. The clinicians, the partner pharmacy, and any third-party service providers each carry their own warranties and disclaimers, which apply on their own terms and are not modified by this section.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the disclaimers in this section apply to the fullest extent the law allows, and any non-excludable warranty is limited to the minimum required by that law.

Limitation of liability

To the maximum extent permitted by law, neither Fuji nor its officers, directors, employees, contractors, agents, suppliers, or licensors will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the platform, the services described in these terms, any clinical service rendered by the network, or any medication dispensed by the partner pharmacy. This exclusion includes lost profits, lost revenue, lost data, lost opportunities, loss of goodwill, and the cost of substitute services, regardless of whether the claim is brought in contract, in tort, under statute, or on any other basis.

The aggregate liability of Fuji to you for all claims arising out of or related to the platform and these terms, in any 12-month period, will not exceed the greater of (a) the total fees you paid to Fuji in the 12 months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100). This cap is an essential element of the bargain reflected in these terms, and it applies regardless of the legal theory on which a claim is brought and regardless of whether the limited remedy described in this agreement is found to fail of its essential purpose.

The limits in this section do not apply to liability that cannot be limited by law: certain claims for personal injury caused by gross negligence or wilful misconduct, certain consumer-protection rights granted by the state where you live, and any liability of an independent clinician or the partner pharmacy for their own professional services. Those liabilities sit with the parties responsible for them and are governed by the law that applies to those parties.

Indemnification

You agree to indemnify, defend, and hold harmless Fuji, Fuji RX LLC, and their respective officers, directors, employees, contractors, agents, suppliers, and licensors from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the platform; (b) your breach of these terms; (c) your violation of any third party's rights, including any intellectual-property or privacy right; (d) any inaccurate or incomplete information you provided at intake or during care; or (e) your violation of any law in connection with your use of the platform.

Fuji reserves the right, at its own expense, to assume the exclusive defence and control of any matter for which you are obligated to indemnify us. If we do so, you agree to cooperate with our defence and not to settle the matter without our prior written consent.

Arbitration agreement and class-action waiver

This is one of the most important sections of these terms. Read it carefully.

Any dispute, claim, or controversy arising out of or relating to these terms, the platform, the services, the clinical relationship as it touches the platform, or the dispensing of medication through the partner pharmacy, between you and Fuji, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by a single arbitrator. The seat of the arbitration will be Wilmington, Delaware, and unless you and Fuji agree otherwise, the arbitration will be held remotely by video.

The arbitrator has exclusive authority to resolve any threshold question of arbitrability, including whether a particular claim falls within the scope of this agreement. The arbitrator will apply the substantive law of the State of Delaware, without regard to its conflict-of-law principles. Judgment on the award may be entered in any court of competent jurisdiction.

You and Fuji agree that each party may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate the claims of more than one person, may not preside over any form of representative proceeding, and may not award relief that runs to anyone other than the named parties.

If the class-action waiver in this section is found to be unenforceable for any reason, the arbitration agreement as a whole will be void, and the dispute will instead be resolved in a court of competent jurisdiction as described in the section on governing law and venue.

Small-claims actions are not subject to this arbitration agreement. Either party may bring an individual claim in a small-claims court of competent jurisdiction, provided the claim stays in that court and the relief sought is within the court's monetary limits.

Opt-out

You have the right to opt out of this arbitration agreement. To opt out, send a signed notice to [email protected] within 30 days of the date you first accepted these terms. The notice must include your name, the email associated with your account, and a clear statement that you intend to opt out of the arbitration agreement in the Fuji Terms and Conditions. If you opt out within the 30-day window, the arbitration agreement and the class-action waiver in this section will not apply to disputes between you and Fuji. Opting out of arbitration has no effect on the rest of these terms, which continue to apply.

The 30-day opt-out window runs from your first acceptance of these terms and does not restart on subsequent revisions. Material changes to this arbitration section that we make later will trigger a fresh notice and a fresh opportunity to opt out, as described in the section on modifications.

Governing law and venue

These terms, your use of the platform, and any dispute that is not subject to arbitration are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, and by US federal law where federal law applies. For any dispute that proceeds in court rather than in arbitration (because a court declines to enforce the arbitration agreement, because the dispute falls outside its scope, or because you have opted out of arbitration as described in the previous section), you and Fuji submit to the exclusive jurisdiction of the state and federal courts located in Delaware, and each party waives any objection to venue or to the convenience of that forum.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.

Force majeure

Neither party is liable for a failure to perform under these terms when the failure is caused by an event beyond reasonable control: an act of God, a natural disaster, a pandemic or public-health emergency declared by a competent authority, a war, an act of terrorism, a civil disturbance, a strike or labour action, a government order, a regulatory enforcement action, a failure of a public utility, a cyberattack of significant scale, an interruption of internet or telecommunications service, a supply-chain disruption affecting an active pharmaceutical ingredient, or any comparable event. The affected party will give prompt notice once the event becomes known to it, will use reasonable efforts to mitigate the effect, and will resume performance as soon as practicable.

This section does not excuse a failure to pay money that was already due before the force-majeure event began.

Modifications to these terms

We may revise these terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material revisions, we will give you notice through the contact channel on your account. Material revisions take effect on the date stated in the notice, never earlier than 30 days after notice is sent. Non-material revisions take effect on posting.

If a material revision changes the arbitration agreement in a way that affects your rights, the notice will include a fresh 30-day opportunity to opt out of arbitration as it applies to disputes arising after the effective date of the change. The opt-out procedure mirrors the one described in Section 18.

Continued use of the platform after a revision takes effect is acceptance of the revision. If you do not accept a revision, your remedy is to stop using the platform and to close the account, in which case the revised terms will not govern any future activity.

Notices

We give you notice through the email address on your account, through a banner shown when you next sign in, or, where the matter calls for a more formal record, by postal letter to the shipping address on file. You give us notice by writing to [email protected] from the email address on your account, or by postal mail to the address shown in the contact section below. Notices are effective on the date sent for email and on the date of delivery (or first attempted delivery) for postal mail.

If a notice requirement in another section of these terms is more specific than this one, the more specific requirement controls.

Severability and entire agreement

If a court of competent jurisdiction finds any provision of these terms unenforceable, that provision will be enforced to the maximum extent permitted by law and the remainder of the agreement will remain in full force. A waiver of any provision must be in writing signed by the party giving the waiver, and a single waiver does not waive any other provision or any later breach of the same provision.

These terms, together with the Privacy Policy, the HIPAA Privacy Notice, the SMS Privacy and Consent notice, the Shipping Policy, the safety information, and any other policy referenced by URL in these documents, are the entire agreement between you and Fuji regarding the platform and the services described here. They supersede any prior or contemporaneous agreement, representation, or understanding on the same subject. No oral statement, sales-channel description, or marketing copy modifies them.

You may not assign or transfer your rights under these terms without our prior written consent. We may assign our rights, in whole or in part, in connection with a financing, an acquisition, or a sale of business assets, on notice to you.

Effective date

These Terms and Conditions take effect on 23 May 2026 and were most recently updated on 23 May 2026. They supersede any prior terms of service issued by Fuji. If you began using the platform before the effective date, the prior terms governed your use up to that point; from the effective date, this version governs.
